1. ACCEPTANCE OF TERMS

By accessing www.famlova.com ("Site") or purchasing personalized products (e.g., engraved jewelry, custom home decor, embroidered apparel), you agree to these legally binding Terms. If you represent a business entity, you warrant authority to bind that entity.

2. CUSTOMIZATION-SPECIFIC TERMS

2.1 User Responsibilities for Custom Orders:

  • Content Ownership: You confirm submitted names/images/text are owned by you or legally authorized.

  • Accuracy Verification: Double-check spelling, sizing, and design placement before payment. Errors caused by user input are not eligible for refunds.

  • Prohibited Content: No hate speech, trademarks, illegal material, or public figure depictions.

2.2 Production & Cancellation:

  • All Sales Final: Custom orders enter production immediately upon payment. No cancellations/changes after submission.

  • Production Timeline: 3-7 business days processing + shipping time.

3. PRODUCTS & INTELLECTUAL PROPERTY

3.1 Scope:

  • Personalized jewelry, home goods, apparel with names/images.

  • Non-custom accessories & home decor.

3.2 Intellectual Property:

  • Your Content: Grant Famlova a non-exclusive license to produce your item and use anonymized designs for marketing.

  • Famlova's Rights: Logos, product designs, and site content are protected. Reverse engineering or scraping is prohibited.

4. PAYMENT & TAXES

  • Currency: USD only.

  • Sales Tax: Collected based on U.S. delivery address per state laws.

  • Custom Orders: Full prepayment required to start production.

5. RETURNS & REFUNDS

Product Type Policy
Personalized Items Non-returnable unless defective (submit photo proof within 7 days).
Non-Custom Items Return within 30 days if unused, in original packaging. Buyer pays return shipping.
Defects We cover return shipping and provide replacement/refund.

6. DISCLAIMERS & LIMITATIONS

6.1 Product Use:

  • Jewelry may contain small parts – keep away from children.

  • We do not prescreen custom content. You indemnify us against third-party claims (Section 9).

6.2 Liability Cap:
Famlova's total liability shall not exceed the product price. Excluded liabilities include:

  • User-submitted errors in customization.

  • Shipping delays/customs seizures.

  • Consequential damages (e.g., lost profits).

7. PROHIBITED ACTIVITIES

You may not:

    • Resell customized products as mass-produced goods.

    • Use bots/scrapers to copy designs or prices

  • Submit false information during checkout.

8. GOVERNING LAW & DISPUTES

  • Jurisdiction: Governed by California law.

  • Arbitration: Claims resolved via binding arbitration in San Francisco, CA (AAA rules). Class actions waived.

9. INDEMNIFICATION

You agree to defend and hold Famlova harmless from claims arising from:

  • Your breach of these Terms.

  • Your custom content submissions.

  • Product misuse.
